Services Agreement and Terms of Use

1. Services to be provided by Studios Boheme are as follows:

 

Eden or Posh Studio Photoshoot (the “Photo Session”)

  • 50-minute studio rental.

  • 50-minute photo session with the photographer provided by Studios Boheme.

  • 5 retouched digital images in large format suitable for prints and in a compact format suitable for social media.

  • 15 color corrected digital images in large format suitable for prints and in a compact format suitable for social media.

  • Phone consultation prior to the photoshoot conducted by the photographer. The photographer will discuss with you the desired outcomes of the photoshoot, provide recommendations for clothing/color scheme and make-up. 

  • Complimentary drinks in the lobby.

  • Complimentary use of our beauty corner.

  • Complimentary use of studio props and decorations.

Headshots

  • Up to 30 minutes studio rental.

  • Up to 30 minutes photo session with the photographer provided by Studios Boheme.

  • 3 retouched digital images in large format suitable for prints and in compact format suitable for social media.

  • Complimentary drinks in the lobby.

  • Complimentary use of our beauty corner.

 

2. Length of photo session and studio use

Please note that while you select a 1-hour window for your Photo Session, the actual time spent with the photographer is 50 minutes. The last 10 minutes of the hour will be dedicated to cleaning and getting the space ready for the next client. Photo session begins promptly at the prescribed starting time and ends promptly 10 minutes before the end of the hour. In the event of late arrival, the Photo Session will still end promptly 10 minutes before the end of the hour. No exceptions will be made. Please arrive 10 minutes before the start of your Photo Session. This time will be needed to process any remaining payment and sign the waivers.

 

3. Delivery and file storage

Studios Boheme will deliver 5 retouched digital images and 10 color corrected digital images in large and compact formats within 2 weeks after the date of Photo Session via DropBox link or a similar medium (sharepoint website), however, processing and editing photographs might take up to 4 weeks during busy periods, such as holidays. For Headshots, Studios Boheme will deliver 3 retouched digital images within 48 hours after the date of the appointment via the medium outlined above. No printed copies of the images will be delivered.

 

Studios Boheme keeps client files for up to 3 months after the photography session and is not liable for any claims after this period. All client files will be removed from the sharepoint website and backups might not be available after this period. It is the client’s responsibility to save local copies of the photographs within the 3-month period.

 

4. Payments and deposits

A non-refundable 50% deposit is required at the time of the booking. It is the client’s responsibility to read the STUDIOS BOHEME LLC PHOTOGRAPHY SERVICES AGREEMENT AND TERMS OF USE (the “Agreement”) prior to booking the Photo Session. A copy of the Agreement is available on the website. Payment of the remaining balance will be due upon arrival before the beginning of the Photo Session. See Section “5. Cancellations and postponements” below for additional details. All sales are final, and no refunds will be issued.

 

5. Cancellations and postponements

A non-refundable 50% deposit is a fee to reserve your Photo Session date and time. This fee is non-refundable. Photo Session may be rescheduled if the client contacts the studio at least 48 hours prior to the Photo Session date. In this case, the deposit can be applied to the new date of the Photo Session. The Photo Session may only be rescheduled once, and the rescheduled time and date is subject to the studio availability.

 

If the client is unable to attend the photo session due to force majeure (fire, flood, earthquake, elements of nature or acts of God, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, or any other similar cause beyond the reasonable control of the client), reasonable effort will be undertaken by Studios Boheme to reschedule the photo session.

 

No exceptions will be made as these rules are established to ensure the high quality of service and respect for both the client’s and photographer’s time.

 

6. Creative coverage

Client accepts that all photographs will be taken and edited at the Studios Boheme’s discretion based on its photographers’ experience and artistic view. Studios Boheme will put every effort to comply with the client’s wishes, however, special requests are not binding instructions and Studios Boheme does not guarantee that any specific client request will be fulfilled.

 

7. Copyright, reproduction, and social media

The client agrees that all copyrights and/or intellectual property rights for all photographs taken at the session shall be held exclusively by Studios Boheme LLC. The client will receive images via online gallery and may print at his/her discretion. The client is encouraged to back up the images upon receiving them. The client’s purchase of the original files releases Studios Boheme LLC from any liability due to loss or damage of the images, and also releases Studios Boheme LLC from any obligation to maintain copies of any digital file, image, or photograph, outside of requirements outlined in section “3. Delivery and file storage”. The client may not sell, distribute or take credit for any of the photos taken by Studios Boheme LLC. Studios Boheme LLC highly recommends that photographs be printed only through a professional printing lab.  If the client prefers to print through a low-quality printer, Studios Boheme LLC is not responsible for client being displeased with those printed products.

 

8. Failure to perform

If Studios Boheme is unable to provide photography services due to illness, mechanical breakdown, accident, acts of God, or any other cause beyond its control, Studios Boheme will return any funds previously paid to the client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Studios Boheme. In the event Studios Boheme fails to perform for any other reason, Studios Boheme shall not be liable for any amount in excess of the retail value of the client’s order.

 

9. Damages to the studio

Any minor incidental damage and normal wear and tear incurred with respect to the property of Studios Boheme during the course of use is expected and the client will not be held liable. However, if damage occurs due to deliberate acts, carelessness, or unwarranted behavior, the client will be responsible for the damage and will pay a market price to restore or replace damaged property. The client is responsible for the entire party that accompanies the client.

 

10. Studio usage rules

  • No smoking is allowed in the building or within 20 feet of any entrance.

  • No outside food and/or drinks.

  • No alcoholic beverages or non-prescription/illegal drugs.

  • Music/voices are to be kept at reasonable levels and shall not contain vulgar or offensive lyrics/words. Live music bands must be approved in advance. The studios are not soundproof.

  • People under the influence of alcohol or other substances will not be admitted to the studio.

  • No pets allowed without prior consent of Studios Boheme.

  • Maximum of six people is allowed to be in the client’s party. Ask ahead if you have a larger group.

  • No projects involving smoke are allowed.

  • The use of fireworks or pyrotechnics is strictly prohibited.

  • Firearms, explosives (such as grenades, land mines, missiles, bombs, etc.), and live ammunition are strictly prohibited.

  • All small and/or hard to clean material (confetti, hair cutting, feathers, food products, body paint, etc.) require prior approval from Studios Boheme. If special cleaning/re-organizing/adjusting is necessary to return the studio to its original state, you may be charged a $50 cleaning fee.

  • At no time are customers to engage in any kind of unlawful activities while on the premises of Studios Boheme.

 

If a representative or group should violate any items of this agreement, Studios Boheme staff will have the right to terminate their occupancy immediately as well as deny them services in the future.
